Mortgages rarely stay with the original lender. They get bundled, sold, and sold again, sometimes passing through three or four different companies before anyone ever misses a payment. Most homeowners never think about this until a foreclosure notice shows up from a company they've never heard of.

That gap matters more than people realize. Before a lender can legally foreclose, they generally have to prove they actually hold the note — the legal right to collect on that specific loan. When a loan's been sold multiple times, that paperwork trail sometimes has gaps, missing assignments, or documentation that doesn't clearly show who owns what.

This isn't a technicality invented to help people avoid paying what they owe. It's a real legal requirement that exists because foreclosure is one of the most serious actions a court allows — and the law demands the party doing it actually has the standing to.

Asking a lender to produce the note, and the full chain of assignments showing how they came to own it, is a completely legitimate step, not a stalling tactic. Plenty of foreclosures have been slowed or stopped entirely simply because that paperwork wasn't in order, and nobody asked until it was almost too late.

If you're facing foreclosure, this is one of the first things worth checking, not something to assume is fine because the bank sounds official.
