Everyone Is Equal Under The Law

How To Win In Court · August 3, 2026
The idea that everyone is equal under the law is one of the most repeated phrases in the American legal tradition, and also one of the most misunderstood in practice. It doesn't mean every case turns out the same regardless of circumstances. It means the rules applied to reach that outcome are supposed to be the same for everyone standing in front of the judge, regardless of wealth, status, or connections.

A judge is bound by the same procedure whether the person in front of them is a landlord or a tenant, a large company or an individual, someone with a lawyer or someone representing themselves. The evidence gets weighed the same way. The deadlines apply the same way. That's the actual meaning of equality under the law — a shared, consistent process, not a guaranteed identical result regardless of the facts.

This principle only does something for the people who actually use the system. Someone who never files, never responds, never shows up doesn't benefit from equal treatment, because equal treatment requires participating in the process in the first place. The equality is available. It's not automatic.

Knowing this is worth something specifically because it removes the excuse that the system is stacked against you before you've ever tested it. The rules are the same for everyone in that room. Whether you use them is the only part that's actually up to you.
